Note : You in this context refer to clients of Exclusive Match Pte Ltd (EM).
Eligibility
- Legal Age. Singles who registers or/and engage EM services must be of minimum age of 21 years at the time of registration.
- Marital Status. Singles who register or/and engage or use EM services must declare and warrant that you are not married. If you are separated, but not yet legally divorced, you may not request to use, register or engage to use, or use EM Services.
- Criminal Records. By requesting to use, registering or engaging to use, and/or using EM Service, you represent and warrant that you have never been convicted of any crime in Singapore and/or any other countries and are not required to register as a sex offender with any government entity. Exclusive Match Pte Ltd DOES NOT CURRENTLY CONDUCT CRIMINAL BACKGROUND SCREENINGS ON ITS MEMBERS. However, EM reserves the right to conduct a criminal background check, at any time and using available public records, to confirm your compliance with this requirement.
Use of EM services
- EM services are applicable only in Singapore. EM has a standard sales and agreement terms and condition spelled out in our contract.
- Accuracy of Information. You hereby declare that all information you have provided, whether written or verbally shall be accurate. You will not provide inaccurate, misleading or false information to EM or to your dates set up by EM. If information provided to EM or your dates set up by EM subsequently becomes inaccurate, misleading or false, you will promptly notify EM.
- Safety Precaution. You assume all risk when using the EM Services, including but not limited to all of the risks associated with any offline interactions with others, including dating. You agree to take all necessary precautions when meeting individuals through our Service. In addition, you agree to review and follow our Safety Dating Tip under Dating Guidelines & Advice, which will be provided to you during the contractual signing.
- Information Verification. EM makes every effort to screen out dishonest client, but assessing someone’s truthfulness and honesty can sometimes be difficult. You will be assured that EM will do it’s best to screen, use various ways of verifying information that client provides. However, none of those ways are perfect, and you agree that EM will have no liability to you arising from any incorrectly verified information. We make no guarantees, either express or implied, regarding your ultimate compatibility with individuals you meet through our Service or as to the conduct of such individuals. However, you agree to take all necessary safety precaution to protect yourself during dating and will promptly report any misbehavior of individual deem unsatisfactory to EM and we will investigate and take appropriate action against such individual if he/she is found to be in violation of EM terms and conditions.
- Complaints. Whenever you deem EM services to be dissatisfactory, you will not harass, annoy, intimidate or threaten any EM employees or agents engaged in providing any portion of the Services to you. You are to make customer complaint through any of our employee or agents in a professional manner. EM is committed to settle and resolve any issues with you in a professional and acceptable manner according to Code of Professional conduct for Dating Agency Criteria and Standard for Dating Agency
- Disclosure. EM holds high standard in ensuring the confidentiality and security of all client information. This includes protection of online and offline data that must be secured to the extent deem appropriate. However, you acknowledge and agree that EM may disclose information you provide if required to do so by law, at the request of a third party, or if we, in our sole discretion, believe that disclosure is reasonable to (1) comply with the law, requests or orders from law enforcement, or any legal process; or (2) protect someone’s health or safety, such as when harm or violence against any person (including the user) is threatened.
Termination and Cooling Off Period
EM Contractual Agreement will become effective upon your signing and acceptance of EM Contractual Agreement in Appendix A and will remain in effect for the duration of the contract unless terminated hereunder unless otherwise as follows.
- 3-Day Cooling period. All EM contracts will have 3 days cooling off period. As EM client, you may cancel the Agreement, without any penalty or obligation, at any time prior to midnight of the third business day following the date of this Agreement, excluding Sundays and holidays. To cancel this Agreement, mail or deliver a signed and dated notice, or send an email which states that you are canceling this Contractual Agreement, or words of similar effect. For EM Services, the day that you submit a completed subscription form will be the date of this Agreement. Any refunds (minus the 1.7% nets charges if paying by nets) under this 3-day cancellation cooling off policy will be made within 10 working days after EM receipt of your cancellation notice.
- Termination. If for any reason you are relocated to another country of which EM has no office in, you are entitled to a prorated refund less the membership fee. The Company shall refund to the Client the unused portion of introductions less the membership fee of no more than S$200. The same refund shall apply in the event the Company despite its best efforts and by its own admission is unable to provide the Client with the agreed number of introductions within EM stipulated timeframe as agreed under EM contractual Agreement.
Indemnification
- To the maximum extend permitted by applicable law, in no event will EM be liable for any damages whatsoever whether direct, indirect, consequential and/or incidental arising in connection with the use of EM services, including without limitation, bodily injury, emotional distress, and/or other damages resulting from communicating or meetings with others EM clients during dating or dating events who registered under false pretenses or who attempt to defraud or harm you.
- You agree to indemnify, defend and hold harmless EM, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorneys’ fees) relating to or arising out of (a) your use of or inability to use EM Services, (b) your violation of any terms of this Agreement or; (c) your violation of any applicable laws, rules or regulations. EM reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with EM in asserting any available defenses.
Dating Guidelines & Advices
The following guidelines and advices are written to help singles experience dates that are safe, enjoyable and yet give the new relationship ventures a chance to succeed.
- Always be kind and respectful of your date. Treat your matches as you would want them to treat you. As chemistry and liking in relationship is complex, EM does not guarantee that every match is going to be right for you. However, we do our best to bring two compatible people that would have a high probability of success together. It is important that you carefully consider whether this particular person is one with whom you would like to further a relationship. You should treat each date with respect and friendliness in your communication even though you have no intention to continue the relationship. If you feel the need to end all form of communication, then be honest, direct and yet kind, gracious and polite.
- EM matching process hope to bring about good & compatible matches, however keep in mind that compatibility alone does not eliminate the need for real-life experience. It is important to pace your relationship - get to know each other in a deep, revealing and meaningful way by sharing a broad base of experiences together. The more experiences you share, the better your chances of avoiding hidden and sometimes unpleasant surprises. So allow time for a variety of experiences together.
Dating Safety Tips
Many singles find dating to be exciting and yet can be anxious, especially the first date with a stranger. This is the time for singles to explore new friendship and learning to relate to opposite gender. Sometimes, the level of chemistry and connection can be exciting, but don't let excitement cloud your ability to exercise reasonable caution. EM suggests you take the following safety measures:
- Limit alcohol consumption or abstain entirely until you know the person better.
- EM always arranges dates at public restaurant where transport is easily accessible for those who do not drive. It's never a good idea to get into someone's personal vehicle on first few dates. Wherever possible, drive yourself, or take a taxi.
- Even on subsequent few dates, EM advices client to choose the time and place of your date wisely as you get to know your match. Meet in a public place at a decent hour during which lots of people will be around. Do not go to secluded area for the date.
- Tell at least one friend or family member about your date - the time and place. EM encourages you to do this until you are sure of the credibility of your date and can trust him/her.
- Carry a fully charged mobile phone with easily accessible numbers for help.
- Don’t leave any personal belongings, such as bag, purses, wallets, jackets with pockets, that may contains items that could reveal personal information about you, such as a cash cards , credit cards, ATM receipts, etc.
- Never give any personal information if you are not comfortable with the person you date. EM will gather feedback and provide the service for further connection.
Use your Judgment & Trust your instincts
EM works hard to screen out dishonest client and do it’s best to use various available means of verifying information that client provides. However, assessing someone’s truthfulness and honesty can sometimes be difficult. Therefore, use your judgment and trust your instincts during dating. If anything makes you uncomfortable during the dates, close the communication, leave for your own safety and protection. You're in control of the entire process, so be sure to choose a comfortable pace to develop the relationship.
Pay special attention to someone who:
- Asks for money
- Asks inappropriate questions
- Wants to speed up the pace beyond your comfort level or getting overly close, overly fast
- Urges you to compromise your principles
- Invite you to their house on the first few dates, especially the first date
